Legal Basis for Market Surveillance

CE Marking and Harmonised Products
CE marking can apply where product-specific EU harmonisation legislation requires it. The importer must check the applicable product law, conformity assessment route, EU declaration of conformity, technical documentation, labelling, instructions, traceability and economic-operator duties.

EUDR
Regulation (EU) 2023/1115 on deforestation-free products, CELEX 32023R1115, creates due diligence obligations for covered commodities and relevant products. Official link: EUDR.
Covered goods require product, supply-chain and due-diligence analysis. Customs data alone is not enough.
Key Compliance Points
- Identify product law by product characteristics and intended use, not only by customs code.
- Check whether an EU responsible person, importer, authorised representative or manufacturer obligation applies.
- Preserve conformity declarations, certificates, test reports, labels, instructions and registration evidence.

- Check whether EU CSW-CERTEX verifies certificates for the product area.
